Early-access terms

This page explains how an early-access engagement with CHINOOK works, so you know what to expect before you sign up. It summarises the terms we offer.

The binding terms are in the written agreement we sign with your organisation before any data is shared. If this page and that agreement differ, the agreement applies.

Draft for legal review. This page describes how we actually handle information today, but a lawyer hasn't reviewed it yet. If anything here matters to a decision you're making, write to chinookintelligence@gmail.com and we'll answer directly.

What early access is

Early access is a working relationship with a small number of organisations that commission or operate liquid-cooled data halls. You get CHINOOK applied to your own data and a direct line to the people building it. We get feedback from real sites that shapes what we build next.

An engagement usually follows these steps:

  1. Introductory call. We learn about your halls and agree whether early access is a good fit.
  2. Agreement. We sign an early-access agreement, including confidentiality and data protection terms, before you share any data.
  3. Trend audit. You share a historian or BMS trend export. We map the points, run the checks and walk you through the findings.
  4. Optional next steps. If both sides want to, we agree in writing to add live data through an edge agent, integrated systems testing on site, or continuous checking.

Any fees, or the absence of them, are set out in the agreement. Signing up for early access doesn't commit you to anything.

What we commit to

  • Read-only. During early access, CHINOOK never writes to, commands or changes any of your systems. The component that can change setpoints is not deployed in early access.
  • Outbound connections only. If you add live data, the edge agent only makes outbound connections. No inbound access to your plant network is needed.
  • Evidence with every finding. Each finding comes with the data, the rule and the reasoning behind it.
  • Honest reporting. We tell you when a result is inconclusive or when a check doesn't apply to your plant, rather than guess.
  • Named people. You have named contacts at CHINOOK for the whole engagement.

What we ask of you

  • Share only data that you are entitled to share, and tell us about any restrictions on it.
  • Give us a contact who can answer questions about the plant and its point naming.
  • Tell us what was useful, what was wrong and what was missing.
  • Use findings as input to your own engineering judgment. Have qualified people review them before acting.
  • Don't share our software, documentation or non-public information outside your organisation.

Your data

  • You own it. Your plant data, documents and results derived only from them remain yours.
  • We use it only to serve you. We process your data to run the engagement for you. We don't sell it, share it with other customers, or use it to build models for other customers.
  • Shared learning is opt-in. Contributing anonymised fault patterns to improve CHINOOK for everyone requires your separate written consent, which you can withdraw.
  • Location. We agree in writing where your data will be hosted before you share it.
  • Deletion. When the engagement ends, we delete your data within 30 days, or return it first if you ask. We can confirm deletion in writing.

Personal information inside your data, such as the names of users or technicians, is handled under the data protection terms in the agreement.

Confidentiality and publicity

Both sides keep each other's non-public information confidential, use it only for the engagement, and protect it at least as well as their own. The agreement sets the details and how long the obligation lasts.

We won't name your organisation, use your logo, or publish anything about your site without your written permission.

Pre-release software

Early access uses software that is still being developed. That means:

  • features may change, be added or be withdrawn during the engagement;
  • there is no service-level commitment unless the agreement sets one;
  • we don't yet hold SOC 2, ISO 27001 or IEC 62443 certification;
  • CHINOOK is decision support, not a safety system. It must never be relied on to protect people or equipment.

Feedback

We may use your feedback about CHINOOK to improve the product, without obligation. Using feedback never gives us rights to your data or your confidential information.

Ending early access

Either side can end an engagement at any time with written notice, under the terms of the agreement. When it ends, we stop processing your data and delete it as described above. Confidentiality continues for the period the agreement sets.
